Terms and conditions of using escrow

These Terms of Use ("Terms of Use" or "Agreement") shall serve as an agreement that sets forth the terms and conditions which will govern your use and participation in the transaction management and escrow services provided on and through this platform. By selecting to utilize the Services you shall have also indicated your acceptance of these Terms of Use and your intent and agreement to be bound by them. If you are unwilling to agree to these Terms of Use, you shall discontinue further use of the Services. If you agree to these Terms of Use, you will be bound as follows:
  1. Definition - "Members" means buyers and sellers participating in the transaction. "Platform" refers to telegram or WhatsApp group being used to perform the transaction. "Admin" refers to the escrow account owner.
  2. Description of the service - Escrow is a service offered by a trusted online individual who has overseen and mediated several transactions online. The service is offered online through WhatsApp or telegram openly through the group chat.
  3. Limits on the service - The service is only available for legal services that can be carried out electronically online and whose delivery can be easily confirmed and verified by the admin.
  4. Prohibited Transaction - Members shall not utilise the service in connection with transaction that is illegal or involves stolen funds, bitcoin, currency or tokens.
  5. Rejection of Payment - Since the use of a bank account or the making of an electronic funds transfer may be limited by your agreement with your financial institution and/or by applicable law, admin is not liable to any member if admin does not complete a Transaction as a result of any such limit, or if a financial institution fails to honor any credit or debit to or from an Account. Admin may post operating rules related to payment on this platform and change such rules from time to time.
  6. Obligations of sellers - Sellers are required to be prompt in their delivery of services and comply strictly to agreement made with the buyers. Sellers are also urged to wait to receive order from admin before delivery of services.
  7. Obligations of buyers - Buyers are required to be prompt and timely in confirming receipt of services from sellers.
  8. My responsibility - Admin is obligated to perform only those duties expressly described in this Agreement and the General Escrow Instructions. Admin shall not be liable for any error in judgment, for any act taken or not taken, or for any mistake of fact or law, except for gross negligence or willful misconduct. Admin may rely upon any notice, demand, request, letter, certificate, agreement or any other document which purports to have been transmitted or signed by or on behalf of a member indicated as the sender or signatory thereof and shall have no duty to make any inquiry or investigation.
  9. Cancellation of transaction - If a Transaction cannot be completed for any reason, including those cancelled by the admin, admin will notify the members involved in such transaction through the platform provided for carrying out such transaction. Admin in his sole discretion may cancel transaction if buyers or sellers fail to comply with the agreement made before entering into transaction. Also note that escrow fees are not refundable and in cases where funds have been sent to escrow account and a transaction is cancelled by either buyer or seller, or by the admin due to error and negligence on the part of members, admin will only refund the price agreed on for the transaction.
  10. Fees - Unless otherwise agreed upon by each member in the Transaction, Buyer agrees to pay the fees for the Services that are disclosed on the platform at the time the completed Transaction Escrow Instructions are agreed to by all such members. Once paid, escrow fees are nonrefundable. Escrow fees may change from time to time in admin's absolute and sole discretion.
  11. Confirmation and verification of transaction - Admin relies on the proofs of delivery or payment as provided in the screenshot of transaction, document of account statement and so on provided by members. In case of misunderstanding as regarding these proofs, you agree to allow admin to mediate dispute by giving authorized access to any means by which he may be able to confirm and verify the transaction.
  12. Limitation of Liability - TO THE EXTENT PERMITTED BY APPLICABLE LAW, ADMIN NOR ITS AFFILIATES, SHALL BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL, RELATING TO YOUR USE OF THE SERVICES OR YOUR INABILITY TO USE THE SERVICES.
  13. Termination of Services - Admin may suspend or terminate your use of the Services at any time, without notice for any reason, in Admin's sole discretion.
  14. Indemnification - You agree to indemnify and hold Admin and his affiliates, harmless from any claim, demand, expense or damage, including reasonable attorneys' fees and court costs, arising from or relating to your use of the Services or any violation of this Agreement, the rules contained on the platform, including, without limitation, payment of escrow fees and any reversal or nonpayment of any credit or debit entry.
  15. Force Majeure - Admin shall not be liable to the member for any failure to perform the services contemplated under these terms and conditions due to an event beyond the its control including but not limited to any Act of God, terrorism,war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man-made eventuality or sudden death of the admin, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen.
